Judge Denies Bid to Overturn Same-Sex Marriage Ruling

A federal judge has upheld a gay judge’s ruling to strike down California’s same-sex marriage ban.

The sponsors of Proposition 8 had argued that the original judge in the case, now-retired U.S. District Judge Vaughn Walker, had a conflict of interest because he has had a 10-year relationship with another man and might want to get married.

Walker ruled last year that Proposition 8 violates the U.S. Constitution.

In a 19-page ruling, Chief U.S. Judge James Ware said Walker had no obligation to divulge whether he wanted to marry his own gay partner before he made his decision on Proposition 8.

Tuesday’s ruling doesn’t settle the legal fight over Proposition 8 as the 9th U.S. Circuit Court of Appeals is still considering Walker’s ruling.
